Rule of law - Prof Dicey

According to Prof. Dicey 

        "Rule of law means no man is above the law and every person, whatever be his tank or conditions, is subject to the jurisdiction of ordinary courts.
According to him " every official from Prime Minister down to Constable or collector of taxes is under the same responsibility for every act done without legal justification as any other citizen.

According to Dicey three meanings of the rule of law

1) Absence of Arbitrary Power :
means No man can be punished except for breach of any law


2) Equality before law : Equal subjection of all classes to the ordinary Law of the land administered by ordinary law courts. This means one is above the law.


3) The Constitution is the result of the ordinary Law  It means that the source of the right of individuals is not the written Constitution but the rules as defined and enforced by law.
